These Terms of Service ("Terms") govern your use of the website, services, and SMS program operated by South Bay Barber Institute LLC ("SBBI," "we," "us," or "our"). By using our website, submitting a form, enrolling as a student, or opting into our SMS program, you agree to these Terms. If you do not agree, do not use our website or opt into our SMS program.
These Terms incorporate by reference our Privacy Policy, which describes how we collect, use, and protect your personal information.
1. SMS Program — Description and Use Cases
SBBI operates a Short Message Service (SMS) program for communicating with prospective students, current students, graduates, and other contacts who have opted in.
Use cases include:
Account notifications: Tuition balance reminders, payment confirmations, late payment alerts, and account status updates
Attendance and clock hours: Daily clock-in/clock-out reminders, hour tracking alerts, and pace-of-completion notifications
Scheduling: Class schedule changes, appointment confirmations, and instructor or campus announcements
Enrollment status: Application status, enrollment confirmations, leave of absence reminders, and graduation notifications
Administrative notices: Required forms, document submission reminders, financial aid communications, and other school-related administrative matters
Customer care: Responses to inquiries you initiate
We do not send unsolicited marketing or promotional SMS. All recipients must opt in before receiving messages, as described in Section 2.
2. Opt-In and Consent
You may opt into the SBBI SMS program through one of the following methods:
Submitting a form on our website that includes an explicit, unchecked SMS consent checkbox, and affirmatively selecting that checkbox
Signing an enrollment agreement that contains a written SMS consent clause and providing your handwritten signature
Providing verbal consent in person at our campus, documented and retained on file
Opt-in is voluntary. You may submit a form, enroll, or interact with SBBI without consenting to SMS, and your refusal to opt into SMS will not affect your ability to receive services from SBBI through other channels.
3. Message Frequency
Message frequency varies depending on your status and account activity. Active students may receive several messages per week during periods of active enrollment, while prospective students or graduates may receive messages only occasionally.
4. Message and Data Rates
Standard message and data rates may apply. SBBI does not charge a fee for SMS messages, but your mobile carrier may charge you for sending or receiving text messages depending on your plan. Contact your carrier for details on your messaging plan.
5. Opt-Out — Reply STOP
You may unsubscribe from the SBBI SMS program at any time by replying STOP to any text message we send you. After you send STOP, we will send one final confirmation message confirming that you have been unsubscribed, and you will not receive further SMS messages from SBBI's automated program.
If you opt out, we may still contact you through other channels (email, phone, mail) for matters related to your enrollment, account, or other legal or contractual obligations.
If you wish to opt back in after unsubscribing, you may text START or UNSTOP to the same number, or contact us using the information in Section 10.
6. Help — Reply HELP
For help with the SBBI SMS program, reply HELP to any text message we send you, or contact us using the information in Section 10. We will respond with support information, including how to opt out and how to reach our team.
7. Carrier Liability Disclaimer
Mobile carriers are not liable for delayed or undelivered messages. SBBI is not responsible for any failure, delay, or interruption of message delivery caused by your mobile carrier, your device, network conditions, or any other factor outside our reasonable control. We do not guarantee that any individual SMS message will be delivered to your device.
The SMS program is provided "as is" and "as available" without warranties of any kind, either express or implied, except as required by applicable law.
8. Age Restriction
The SBBI SMS program is intended for individuals 18 years of age or older. Individuals under 18 may not opt into the SMS program independently. Students under 18 who enroll at SBBI must have a parent or legal guardian execute the enrollment agreement and provide written SMS consent on the minor's behalf. SBBI does not knowingly enroll individuals in the SMS program who are under 18 without verifiable parental consent.
If you believe a minor has opted into our SMS program without proper consent, contact us immediately and we will remove their number from our messaging system.
9. Privacy
Your use of the SBBI SMS program and our website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy describes what information we collect, how we use it, how we protect it, and your rights regarding your personal information.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors that support our operations is permitted solely to enable those services. See Section 5 of our Privacy Policy for full details.

We may update these Terms from time to time. The "Effective Date" at the top of this page will reflect the date of the most recent update. Material changes will be communicated to current students through the email or phone number on file. Continued use of our website or SMS program after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising from or relating to these Terms shall be resolved in the state or federal courts located in Santa Clara County, California.
By opting into the SBBI SMS program, you confirm that you have read, understood, and agree to these Terms of Service and our Privacy Policy.
